1. By entering and using this site, you agree to be bound by these terms, which shall take effect immediately on your first use of this site. If you do not agree to be bound by all of the following terms please do not access the site or use its services.
2. The website is provided on an 'as is' and 'as available' basis and we shall not be liable to you for your inability to use the service. No advice or information, whether oral or written, obtained by you via the website will create any warranty not expressly stated in these terms and conditions; and all warranties in respect of the website, the items supplied by us and any other services that we may provide through the website from time to time are excluded to the fullest extent permitted by law. Pigeon Ecards Limited is not responsible for any failure of ecards sent through the website to reach their intended recipients.
3. We reserve the right to amend the website and the items and services that we offer to you via the website and to suspend or close the website, without notice to you from time to time.
4. You must not republish material from this website (including republication on another website); sell, rent or sub-license material from the website; show any material from the website in public; reproduce, duplicate, copy or otherwise exploit material on our website for a commercial purpose; edit or otherwise modify any material on the website except for your own personal, non-commercial use.
5. The content of all parts of the website and the ecards belong to Pigeon Ecards Limited or its licensors. This includes copyright in all of the text, descriptions and images. It also includes trademarks in our name and logos.
6. You agree to use pigeonecards.com only for lawful purposes. You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
7. You must not use our website to transmit or send unsolicited commercial communications.
8. You must not use our website for any purposes related to marketing without our express written consent.
9. Indemnity: You agree to defend, indemnify, reimburse and hold Pigeon Ecards Limited and its members, managers, officers, directors, representatives, employees, agents, successors, designees, licensees, sublicensees and assigns harmless from and against any and all liability, loss, damages, judgments, costs and expenses (including reasonable attorney's fees, costs and expenses and court costs) arising out of or related to:
i. Your use of pigeonecards.com;
ii. any breach or alleged breach of your representations and warranties and/or any breach, alleged breach or violation of the notices, terms and conditions hereof; and
iii. Your violation or alleged or threatened violation of any laws, rules or regulations, or any rights of a third party, including, without limitation, any trademark, copyright, patent, trade secret, defamation, right of privacy or publicity or moral rights of any third party, arising from the submission of your materials.
10. Pigeon Ecards Limited does not warrant that the pigeonecards.com, any part thereof, is free of viruses, worms, trojan horses or any other harmful components.
11. You agree that where you are invited to submit text, your contribution is your own original, is not defamatory; and does not infringe any law; and indemnify Pigeon Ecards Limited against all legal fees, damages and other expenses that may be incurred by Pigeon Ecards Limited as a result of your breach of the above warranty.
Terms of sale
1. Pigeon Ecards Limited hereby grants you a limited licence to use the ecard for two weeks.
2. Payment for your ecards is by PayPal.
3. You accept that pigeonecards.com relies on the work of a single artist, and on the ability of that artist to continue working. Your purchasing of credits does not commit Pigeon Ecards Limited to the future availability of the website nor to the continued release of ecards.
4. CHECK Should pigeonecards.com be closed for any reason or your account termintated, refunds will be given solely at the discretion of the Pigeon Ecards Limited.
5. We may vary these terms and conditions from time to time without notice and you should therefore check them each time you intend to use the website.
6. If any of these terms and conditions is found to be invalid this shall not affect the validity of the remaining provisions which shall remain fully enforceable. No waiver by us of any term shall be deemed to be continuing or shall be deemed to be a waiver of any other term.
These terms and conditions will be interpreted and construed in accordance with the laws of England and Wales and will be subject to the non-exclusive jurisdiction of the English Courts.
